1. Data Collected

NovexistopLabs collects only the personal data necessary to execute the services requested by the user. This includes: full name, email address, phone number, and project-related information voluntarily provided through contact forms or direct communication channels.

2. Purpose and Legal Basis

Personal data is processed under Article 6(1)(b) of the GDPR — the processing is necessary for the performance of a contract or pre-contractual measures. Data is used exclusively for: responding to inquiries, delivering contracted services, issuing invoices and managing payments, and providing post-service technical support.

3. Data Retention

Personal data is retained for the duration strictly necessary to fulfil the purposes for which it was collected. Invoicing data is retained for a minimum of 5 years in compliance with Spanish tax legislation. Contact inquiry data is deleted within 12 months if no contract is established.

4. Data Recipients

NovexistopLabs does not sell, rent, or share personal data with third parties. Data may be shared exclusively with: hosting providers and infrastructure services used for project deployment, payment processors for transaction management, and legal or tax authorities when required by applicable law.

5. International Transfers

NovexistopLabs operates within the European Economic Area. Should any data processing involve transfers outside the EEA, appropriate safeguards such as Standard Contractual Clauses (SCCs) will be implemented to ensure an adequate level of data protection.

Refund Policy

1. Scope

This Refund Policy applies to all services provided by NovexistopLabs, including web development, responsive layout engineering, API architecture, and infrastructure deployment.

2. Project Milestones

Work is structured around clearly defined project milestones. Each milestone represents a deliverable stage of the project. Refund eligibility is assessed based on the milestone at which the termination request is received.

3. Refund Conditions

Full refund: if the project is cancelled before any development work has commenced. Partial refund: if the project is cancelled mid-execution, a proportionate refund is calculated based on the completed and delivered milestones versus the total project scope. No refund: once a milestone has been delivered and accepted by the client, that milestone's fee is non-refundable.

4. Request Process

Refund requests must be submitted in writing to [email protected] within 14 calendar days of the milestone delivery or project termination date. NovexistopLabs will process all valid refund requests within 30 business days.

5. Non-Refundable Items

Third-party service fees (hosting, domain registration, software licences), custom asset creation once delivered, and consulting hours already rendered are non-refundable.

6. Disputes

In case of disagreement regarding refund calculations, both parties agree to negotiate in good faith. If no resolution is reached within 30 days, either party may initiate mediation under Spanish consumer protection regulations.

Terms of Service

1. Acceptance of Terms

By engaging the services of NovexistopLabs, the client acknowledges and agrees to these Terms of Service. These terms form a legally binding agreement between the client and NovexistopLabs.

2. Service Scope

All services are defined in the agreed project proposal or statement of work. Any work outside the defined scope constitutes additional work subject to separate quotation and agreement.

3. Payment Terms

Invoices are issued according to the milestone-based payment schedule defined in the project proposal. Payment is due within 14 calendar days of invoice date. Late payments accrue interest at a rate of 4% per annum plus applicable statutory interest under Spanish commercial law.

4. Intellectual Property

Upon full payment of all invoices, all intellectual property rights for the delivered work are transferred to the client. NovexistopLabs retains the right to display completed projects in its portfolio unless the client explicitly objects in writing.

5. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the project. This obligation survives the termination of the agreement for a period of 3 years.

6. Limitation of Liability

NovexistopLabs shall not be held liable for indirect, incidental, or consequential damages. Total liability shall not exceed the total fees paid by the client for the specific service giving rise to the claim.

7. Force Majeure

Neither party shall be held liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, war, government restrictions, pandemics, or telecommunications failures.

8. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain.

9. Amendments

NovexistopLabs reserves the right to modify these Terms of Service at any time. Updated terms will be communicated to existing clients via email and will apply to all new engagements.
